A federal judge held veteran investigative reporter Catherine Herridge in civil contempt on Thursday for refusing to divulge her source for a series of Fox News stories about a Chinese American scientist who was investigated by the FBI but never charged.
U.S. District Judge Christopher Cooper in Washington imposed a fine of $800 per day until Herridge reveals her source, but the fine will not go into effect immediately to give her time to appeal.
Cooper wrote that he “recognizes the paramount importance of a free press in our society” and the critical role of confidential sources in investigative journalism. But the judge said the court “also has its own role to play in upholding the law and safeguarding judicial authority.”
“This ruling comes at questionable timing. Just weeks after this ruling, she was fired by CBS and she was working on multiple stories about Hunter Biden's involvement with Joe Biden and all the stuff that they were dealing with Burisma,” Gerald A said. “She's being targeted when she's reporting on an issue that might affect the government,”
Based just four miles from the Pentagon in northern Virginia is an innocuous-sounding online school for "management and technology" – which a Fox News investigation reveals has been at the center of multiple federal probes about its leadership's alleged ties to the Chinese military and whether thousands of records from U.S. service members were compromised.
Photos, exclusively obtained by Fox News, appear to show Chen as a young officer in the People's Liberation Army, the military wing of China's communist party. Another photo shows Frame saluting his wife, Chen, who is holding a uniform. Three independent experts said it was a Chinese military colonel’s uniform.
Yet since those FBI raids, UMT has continued to collect more than $6 million from Defense Department tuition assistance programs as well as the Department of Veterans Affairs through the post-9/11 GI bill.
“Herridge revealed how they continued to receive funding from the Department of Defense and… no charges were ever filed for her. Nothing happened to her,” Gerald A said.
Chen sued the FBI and Justice Department in 2018, accusing the government of violating the Privacy Act — which prohibits the public disclosure of private information about individuals without their consent. Chen’s lawsuit says both her personal and professional life were upended amid a wave of negative media attention after the leak, leading to hate mail and death threats,” according to AP.
However, the judge said that Herridge’s right as a journalist does not supersede "Chen’s need to know for the sake of her lawsuit.” according to AP.
“Her need for information on her privacy being violated, on a lie that she told with some shady connections to the DOJ, that overcomes a First Amendment right of a journalist. That is absolutely terrifying,” Gerald A said. “
CBS fired Herridge and then seized all her documents and did not give them back for two weeks. Those records included information on stories related to the Bidens that she was pursuing.
“Wouldn’t that have a chilling effect? Wouldn't that make it less likely for people to come forward with information - especially about the Bidens?” Gerald A said.
However, the judge disagreed.
“It should be ironclad,” Gerald A said. “You have to be able to expose people.”
