Federal judge to illegals: Yes, of course you can own guns
While Liberals do anything and everything to take the guns away from law-abiding citizens, it seems that some don’t care if migrants have them even though they have technically broken federal immigration laws. And most people who break federal laws usually cannot own firearms but I guess that does not matter when no human is illegal.
A federal judge in Illinois ruled that it is unconstitutional to prohibit illegals from owning guns.
A federal judge in Illinois has found that the Constitution protects the gun rights of noncitizens who enter the United States illegally.
U.S. District Judge Sharon Johnson Coleman on Friday ruled that a federal prohibition on illegal immigrants owning firearms is unconstitutional as applied to defendant Heriberto Carbajal-Flores. The court found that while the federal ban is "facially constitutional," there is no historical tradition of firearm regulation that permits the government to deprive a noncitizen who has never been convicted of a violent crime from exercising his Second Amendment rights.
"The noncitizen possession statute … violates the Second Amendment as applied to Carbajal-Flores," the judge wrote. "Thus, the Court grants Carbajal-Flores' motion to dismiss."
Coleman, a President Obama appointee, cited the landmark Supreme Court decision in New York State Rifle and Pistol Association v. Bruen (2022), which established a new standard to determine whether a law violates the Second Amendment. Since Bruen, a multitude of federal and state gun control measures have been challenged in courts with mixed results.
In this case, U.S. v. Carbajal-Flores, the court considered whether people who enter the country illegally can be banned from owning firearms.
Disregarding federal immigration laws used to be considered a federal crime. However, that does not seem to matter even though the majority of states restrict firearms to convicted felons.
Not only do we not know who any of these migrants are or what they want, but they may or may not be armed as well.
Unlike citizens, migrants don’t go through proper TSA pre-checks before boarding a plane like Americans have to do. It is unclear how the illegal in question obtained a gun considering I doubt it’s legal from whatever country he is from and I am sure it is near impossible to go through a background check without the proper identification, but I digress.
Illinois has some of the strictest gun control laws in the nation. Which is what makes this all that much more infuriating.
Entering the country is a felony. This should simply bar one from possessing a gun - especially because it is allegedly constitutional to strip Americans of this right once convicted of a felony. But that is not the case when no human is illegal.
You know, it seems as if there is a huge effort to strip constitutional rights away from Americans while affording special rights to migrants. I wonder why that is.
