Illinois Becomes The First State To Abolish Cash Bail Completely
Starting today, judges in Illinois can no longer order people to put up money to get out of jail while awaiting trial. Illinois is the first state to ban it completely, although other states have eased regulations, according to NPR.
But don’t worry, I am sure this won't increase crime at all, and will only fix racism for good.
The new law, which is ironically part of the SAFE-T Act that eliminates cash bail, will generally allow those charged with most crimes to remain free pending trial.
The law was supposed to eliminate the use of cash bail across the state on Jan. 1, but that was put on hold after prosecutors and sheriffs in 64 counties filed lawsuits claiming the law was unconstitutional, and a Kankakee County judge ruled in their favor.
In a 5-2 ruling in July, the state's highest court overturned that ruling.
"The Illinois Constitution of 1970 does not mandate that monetary bail is the only means to ensure criminal defendants appear for trials or the only means to protect the public. Our constitution creates a balance between the individual rights of defendants and the individual rights of crime victims. The Act's pretrial release provisions set forth procedures commensurate with that balance," Justice Mary Jane Theis wrote in the ruling.
Is it really a balance between crime victims and defendants? Because my gut tells me otherwise.
When criminals are not required to post bail, this will OBVIOUSLY lead to an increase in crime.
Bail reform changes in Cook County have led to a “substantial increase in crimes committed by pretrial releases in Cook County,” and the “number of released defendants charged with committing new crimes increased by 45%.” And “the number of pretrial releases charged with committing new violent crimes increased by an estimated 33%," according to an empirical assessment.
Once again, progressives are so obsessed with giving special treatment to criminals that they could care less what it does to public safety.
"The money bond system wrongly tied access to financial resources to pretrial freedom. The result has been countless individuals – mostly from Black and Brown communities – spending days, weeks, months, years in jail just for being poor," Cook County Board President Toni Preckwinkle said.
The most absurd thing about claiming to want to protect Black communities is that Black people are disproportionately affected as the victims of violent crime.
Black people make up 54.4% of homicide victims even though they are about 14% of the population.
The lack of bail for people accused of crime will no doubt increase the crime rate, which will subsequently increase the amount of Black victims.
If progressives actually cared about Black and Brown communities, they would look at making it harder to commit crimes, not easier.
Although this will decrease the Black jail population, it will do so while increasing the Black morgue population.
