State won't let couple evict squatter, even after they buy $2 million home to take care of son with Down Syndrome
According to the Fifth Amendment, no "person shall be ... deprived of life, liberty or property without due process of law; nor shall private property be taken for public use, without just compensation."
But in New York, they have a different interpretation of this. Because it turns out that tenants have a right to the landlord's property. And by tenants, they mean anyone who steps foot in the house.
Squatter rights is an asinine thing because it turns a criminal trespassing matter into a civil one where the burden of proof falls upon the victim. This is long, costly, and wrong. I don’t understand how officials have been able to enact laws where uninvited guests somehow have rights to another person's property, but here we are with those laws wreaking havoc on unsuspecting victims.
Anyway, the story we have for you is more of the same.
An older couple bought a $2 million home in Queens where they planned to take care of their disabled adult son. However, they never expected to be caught up in a battle with a squatter who is refusing to leave.

According to The New York Post:
A New York City couple’s plan to move into a $2 million dream home to retire in with their disabled son has become a “nightmare” as they battle a squatter who claims he had an agreement with the previous owner.
Susana and Joseph Landa, both 68, purchased the home next to family members in the quiet New York City residential neighborhood of Douglaston, Queens, in October 2023, ABC 7 reported.
Close to relatives, the location was perfect for their son Alex, who has Down syndrome and could be easily looked after if something was ever to happen to the couple.
“I just want to know that I can die tomorrow and he’s next to his brother,” Susana Landa told the outlet Wednesday.
The couple, however, has yet to move into the multimillion-dollar home four months after signing the deed as they try to get rid of squatter Brett Flores.
Flores, 32, was hired on a $3,000-a-week salary by the former homeowner as his caretaker until the man died in January 2023, court documents obtained by the outlet show.
The squatter claims to have a “license” from the dead former owner to stay in the house.
Flores has also been living in the home since the former owner died, which has caused a major headache while they try to get him out.
I am not a lawyer, but I am having a hard time seeing how any of this is conditional.
The squatter has also listed rooms for rent. So not only is he living there for free, but he is profiting off of it. And all bills are being paid by the property owners.
He showed up for court without an attorney on Jan. 9, 2024, preventing any legal proceedings.
Most recently, he filed for bankruptcy, which automatically allowed him to stay in the home.
“When a residential tenant files a bankruptcy petition, an automatic stay prevents the landlord from bringing or continuing a case to obtain possession and from enforcing a judgment obtained before the commencement of the bankruptcy case,” according to New York City law.
The purpose is to allow “the debtor a breathing spell from his creditors.”
The law is written in a way that automatically gives “rights” handed down by the government to people, who did nothing to afford such “rights.” All while punishing the property owners as if they did something wrong.
Here is the squatter. And of course, he is wearing a face diaper.
The property owners are having their property de facto taken away and given to someone else. But, in New York, that is considered lawful. Saying this is nothing more than a “civil dispute," is logically equivalent to saying that this is a civil matter as much as grand theft and joyriding in another person's car is.
This is not just stealing, this is the worst kind of stealing because it’s someone's home. They are stealing someone's most valuable asset. All of this is insane and property owners deserve better. It should not be considered a crime to own property.
But Progressives are envious individuals who hate hard work - especially when people are rewarded for that. This is why housing is a "right" only for people who did nothing to deserve it.
It’s almost as if lawmakers in New York intended to discourage people from owning property.
On top of all of that, the amount of stress this man and the courts are causing this elderly couple, who are just trying to take care of their adult son with Down Syndrome, makes this so much more evil and incredibly heartbreaking.
Sadly, all of this is expected since in New York City, squatters and migrants appear to have more rights than law-abiding citizens.
