Braden Rabidoux is a thirteen-year-old middle-school student who, one day, referred to a classmate he believed to be female as "she." The classmate got emotional about it because, according to the classmate, they are "non-binary" and their pronouns are "they" and "them." Braden's school, Kiel Middle School, is now accusing him of sexual harassment. Braden is speaking out to give his side of the story, out of fear he'll be shunned by colleges due to this discrepancy.

"I was anxious and scared and upset because I didn’t know what was going to happen. But mostly anxious for my present self and my future self because a charge like that on my record could shatter my chances at getting into a college when I grow up."

Did I mention Braden is 13? Because Braden is 13.

"Misgendering" is what some call it when you call someone by their "preferred" gender, as opposed to their birth gender. Some people who were born as a boy or a girl decide later on they don't want to be a boy or a girl and decide they are a girl or a boy. Or a non-binary. If you don't call them by their preferred gender, you are accused of misgendering. Also, sometimes accused of "transphobia."

Critics want to make misgendering someone, whether intentional or accidental, a punishable offense. The Rabidoux family has obtained a lawyer who points out sexual harassment is a serious offense, not simply using the so-called wrong pronoun. "The school’s theory seems to be that any use of a wrong pronoun is automatically punishable speech under Title XI, and if that is truly their position, that is a truly egregious First Amendment violation."

Braden's middle school is making the claim that under Title IX, a law that prohibits sex-based discrimination, misgendering some is "sexual harassment." But Title IX was meant to protect girls. Title IX doesn’t cover the use of preferred pronouns, even though the Department of Education and the Biden Administration really, really want it to.
